Shuttlesworth Lasseter, LLC Announces a $4 Million Verdict Against Police Officer, City of Homewood, Ala.

Homewood, Ala. (May 27, 2015) - Shuttlesworth Lasseter, LLC announces a jury in Jefferson County has returned a $4 million verdict against a Homewood police officer and the City of Homewood.

The plaintiff was run over by a motorcycle officer during a parade event for Special Olympics. Attorney Alan Lasseter of Shuttlesworth Lasseter, LLC, and Rip Andrews of Marsh, Rickard & Bryan, P.C., proved the officer was violating mandatory law by exceeding the speed limit without his siren on as required by law.

According to Lasseter, the decision is significant because it represents one of the first cases in Alabama to establish that police officers can lose their state agent immunity and be held liable in their personal capacity when their negligent conduct and wantonness is a result of their own violation of mandatory law or policy.

The jury on May 21 found the officer was negligent and wanton and awarded compensatory damages of $2 million and punitive damages of $2 million.

"This verdict was not an attack on city employees since our own client worked for the same city for 25 years, and her son worked his whole career for the city," Lasseter said. "The severity of our client's injuries included $400,000 in medical bills and permanent loss of the use of her left arm. The City and officer were covered by $2 million in insurance, and we did absolutely everything we could do over the last several years to settle within limits, and they never even offered us the amount of her medical bills."

The case went to trial after 8 years of litigation and multiple interlocutory appeals on statutory cap and immunity issues, the last of which involved amicus briefs being filed by more than 29 municipalities and police organizations.

The case is Eldeltraud Theresia "Trudy" Roy v. City of Homewood, et al; Circuit Court of Jefferson County, Alabama; case number 01-CV-2007-900894.00.
